Attorney Mike Braverman of the Getz & Braverman law firm in the Bronx, New York is representing a motorcycle rider injured seriously during a recent police stop.
29 year-old Gerardo Aguilera was driving home on his ATV dirt bike when he was struck by an officer. After a memorial ride to honor a fellow rider who was shot and killed by police in 2010, Aguilera claims he was intentionally hit by the officer’s car. Aguilera claims NYPD police officers broke his neck, fractured his spine, and caused several other serious injuries when they attempted to stop his bike with their vehicles.
What Happened
Aguilera says two police cars came out of nowhere and struck him while on his motor bike. The NYPD claims he was driving southbound in the northbound lane and drove into the squad car. Braverman sees the incident as an intentional act by officers and says that the tragedy would not have occurred if officers had simply chosen to stop their vehicles. While motorcycles designed for off-roading and other types of all-terrain vehicles are not allowed on New York streets, enforcement should not involve violence against offenders. “What we see is an intentional act,” Braverman says, “slamming a guy who is defenseless on a bike.” Braverman maintains that the officers’ actions were reckless, causing the motorcycle rider to be injured.
